For the purposes of these Terms:

• "Account" means a unique account created for You to access our Service or parts of our Service.
• "Application" or "App" refers to PlantScope: Plant Identifier, the software program provided by the Company downloaded by You on any electronic device.
• "Company" (referred to as either "the Company", "We", "Us" or "Our") refers to PlantScope.
• "Content" refers to content such as text, images, plant photos, identification data, care notes, or other information that can be posted, uploaded, or otherwise made available by You through the Service.
• "Device" means any device that can access the Service such as an iPhone, iPad, or other iOS device.
• "Feedback" means feedback, innovations, or suggestions sent by You regarding the attributes, performance, or features of our Service.
• "In-App Purchases" refer to additional features, unlimited identifications, or premium functionalities available for purchase within the Application.
• "Service" refers to the PlantScope Application.
• "Subscription" refers to recurring payment plans that provide access to premium features of the Application.
• "User Generated Content" refers to any content, including but not limited to plant photos, custom names, care notes, and garden collections created or uploaded by You.
• "You" refers to the individual accessing or using the Service.

These Terms govern the use of this Service and constitute an agreement between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, then You may not access the Service.

You represent that you are over the age of 13. If you are between 13 and 18, you represent that your legal guardian has reviewed and agreed to these Terms.

Account Creation

You may use basic plant identification features without creating an account. Optional account creation allows access to additional features such as saving plants to your garden, setting care reminders, and syncing data across devices.

Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under Your account. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

Account Termination

We may suspend or terminate Your account immediately, without prior notice, if You breach these Terms or engage in prohibited activities.

Your Right to Post Content

Our Service allows You to photograph plants, upload images, create care notes, and share content. You are responsible for all Content that You post to the Service, including its legality, reliability, and appropriateness.

Content License

By posting Content to the Service, You grant Us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute such Content solely for the purpose of operating and improving the Service. You retain ownership of Your Content.

Content Restrictions

You may not transmit any Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringes on intellectual property rights of any party
• Contains false or misleading information about plants or their care
• Violates the privacy of any third person
• Contains malware, viruses, or other harmful components
• Is spam or constitutes unauthorized advertising
• Impersonates any person or entity
• Contains images of plants from private property without permission

Content Moderation

The Company reserves the right to review, modify, or remove any Content that violates these Terms or is otherwise objectionable. We may also limit or revoke Your use of the Service if You post prohibited Content.

Service Accuracy

Our AI-powered plant identification and care recommendation features are provided for informational purposes only. While we strive for accuracy, we do not guarantee that:

• Plant identifications are 100% accurate
• Care recommendations are suitable for all growing conditions
• Information provided is complete or current

No Professional Advice

The Service does not provide professional botanical, horticultural, veterinary, or medical advice. You should consult with qualified professionals for plant safety, care, or health-related concerns.

Limitation of AI Services

You acknowledge that AI technology has limitations and may produce incorrect results. You use the identification and care recommendation features at Your own risk.

Purchase Terms

The Service may offer In-App Purchases and Subscriptions that provide access to unlimited identifications, advanced care guides, premium garden management tools, or enhanced features.

Payment

All purchases are processed through Apple's App Store. Payment will be charged to Your account upon confirmation of purchase.

Subscriptions

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions through Your device's subscription settings

Refunds

Refund requests must be submitted through the App Store in accordance with their refund policies.

Permission Requirements

The Service requires camera and photo library access to function properly. By granting these permissions, You acknowledge that:

• We access your camera only when you actively take photos for plant identification
• We access your photo library only when you select images to identify
• Photos are processed through our AI models for identification purposes

Photo Processing

Your plant photos are processed to provide identification results. We may retain anonymized, aggregated data to improve our AI models, but we do not store your personal photos without your explicit consent.

Notification Services

The Service may send push notifications for watering reminders, care tips, and app updates. You can control notification preferences through your device settings.

Accuracy of Reminders

Care reminders are general suggestions based on typical plant needs. Actual watering and care requirements may vary based on your specific growing conditions, climate, and plant health.

We may offer promotions, contests, or sweepstakes through the Service. Such promotions may be governed by separate rules that supplement these Terms. If promotion rules conflict with these Terms, the promotion rules will prevail for that specific promotion.

Our Content

The Service and its original content, features, functionality, visual design, logos, trademarks, AI models, and trade dress are and will remain the exclusive property of the Company and its licensors. Our content is protected by copyright, trademark, and other intellectual property laws.

Plant Database

Our plant identification database, AI algorithms, and care information are proprietary to the Company. You may not copy, reproduce, or create derivative works based on our plant database or AI technology.

Your Feedback

You assign all rights, title, and interest in any Feedback You provide to the Company. If such assignment is ineffective, You grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right to use, reproduce, modify, and implement such Feedback without restriction.

Your privacy is important to Us. Our use of Your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, You consent to the collection and use of Your information as described in our Privacy Policy.

You may not use the Service:

• For any unlawful purpose or to solicit unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information about plants or their care
• To interfere with or circumvent the security features of the Service
• To reverse engineer or attempt to extract our AI algorithms or plant database
• To use the Service for commercial plant identification services without our written permission

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your account, You may do so by deleting the Application from Your device or contacting us to delete your account data.

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from Your use of the Service.

In no event shall the Company's total liability to You for all damages exceed the amount You have paid for the Service in the 12 months preceding the claim, or $25 if You have not made any payments.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no warranties, expressed or implied, regarding:

• The accuracy of plant identification or care recommendations
• The safety of identified plants
• The availability or reliability of the Service
• The merchantability or fitness for a particular purpose
• That the Service will be uninterrupted or error-free

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will notify You of any changes by posting the new Terms within the Application and updating the "Effective Date" at the top of this document. Changes are effective immediately upon posting.

Your continued use of the Service after changes are posted constitutes acceptance of the new Terms.
